1. Acceptance of Terms
By accessing or using Birahma (“the Platform”) at birahma.com, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services. These terms apply to all visitors, donors, campaign creators, and other users of the Platform.
2. About Birahma
Birahma is an Islamic crowdfunding platform that enables individuals and registered charities to raise funds for charitable causes. We are committed to Shariah compliance — no fees or charges are deducted from Zakat or Sadaqah donations. Our platform facilitates the connection between donors and campaign creators in a transparent and accountable manner.
3. Eligibility
To use our Platform, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using our services under applicable law
- Provide accurate and truthful information during registration
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
5. Campaign Creators
If you create a campaign on Birahma, you agree to:
- Provide accurate, truthful, and complete information about your campaign
- Only raise funds for lawful, Shariah-compliant charitable purposes
- Use all funds raised solely for the stated campaign purpose
- Comply with all applicable laws, including charity law and anti-money laundering regulations
- Connect a valid Stripe account to receive payouts
- Provide updates to donors on campaign progress
- Not misrepresent your charity status or registration details
6. Donations
All donations made through Birahma are voluntary and generally non-refundable once processed. Donations are processed securely via Stripe. Birahma does not deduct platform fees from Zakat or Sadaqah donations in line with our Shariah-compliant commitment. In exceptional circumstances (e.g. fraud or campaign cancellation), we may facilitate refunds at our discretion.
7. Gift Aid
By submitting a Gift Aid declaration, you confirm that you are a UK taxpayer and that you have paid sufficient Income Tax or Capital Gains Tax to cover the Gift Aid claimed on your donation. It is your responsibility to notify us if your tax status changes. Birahma submits Gift Aid claims to HMRC on behalf of eligible charities.
8. Prohibited Conduct
You must not use the Platform to:
- Raise funds for unlawful, harmful, or non-charitable purposes
- Engage in fraud, misrepresentation, or deceptive practices
- Violate any applicable laws or regulations
- Harass, abuse, or harm other users
- Upload malicious code or attempt to compromise platform security
- Impersonate any person or organisation
- Raise funds for purposes that contradict Islamic principles
9. Intellectual Property
All content on the Birahma Platform, including logos, text, graphics, and software, is the property of Birahma or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
10. Limitation of Liability
Birahma acts as a platform facilitator and is not responsible for the actions of campaign creators or the ultimate use of donated funds. To the fullest extent permitted by law, Birahma shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount of fees paid by you to Birahma in the preceding 12 months.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to These Terms
We reserve the right to update these Terms at any time. We will notify registered users of material changes via email. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
